1. General Terms:
The website, https://charityshoptoxotis.org/, (“Site”) is owned and operated by Toxotis Shop Ltd (“we” or “us” or “our”).
By accessing and placing an order with Toxotis Shop Ltd, you confirm that you agree with and bound by these terms of service (“Terms of Service”) outlined below, as well as our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site.
These Terms of Service apply to the entire Site and any email or other type of communication between you and Toxotis Shop Ltd.
We reserve the right to change prices and revise these Terms of Service, as well as our Privacy Policy, at any moment.
2. Licence:
Toxotis Shop Ltd grants you a revocable, non-exclusive, non-transferable, limited license to use the Site strictly in accordance with these Terms of Service.
3. Definitions and Key Terms:
To help explain things as clearly as possible in these Terms of Service, every time any of the below are referenced, are strictly defined as:
· Services: refers to the services provided by Toxotis Shop Ltd: online shopping of products, which are made by members of Toxotis Charitable Foundation, as well as by artists or other third parties, all of which are donated to Toxotis Shop Ltd for sale, and that profits from such sales, are donated to Toxotis Charitable Foundation
· You or your: a person or entity that is registered with Toxotis Shop Ltd to use the Services or orders without having an account or has subscribed to receive our newsletters
· Parties: you and/or us and/or any other relevant persons
4. Restrictions:
You agree not to, and you will not permit others to commercially exploit the Services.
5. Payment:
You agree to pay for all the fees or charges to your account for the Services in accordance with the fees, charges and billing and shipping terms in effect at the time that each fee or charge is due and payable.
We engage with Stripe for processing your payments. You may refer to Stripe’s Privacy Policy for further details. Providing Stripe with your credit card number and associated payment information, you give Stripe your consent to instantly verify your information, and subsequently invoice your account for all fees and charges due payable to us hereunder. You agree to notify us of any change in your billing and/or shipping address or update/change of your credit card saved for the payment of the Services.
6. Return and Refund Policy:
Thanks for shopping with us. We appreciate the fact that you like to buy our products. We want to make sure that you have a rewarding experience upon purchasing and using our products.
These Terms of Service apply to transactions with us. By placing an order or by making a purchase from us, you agree to these Terms of Service along with our Privacy Policy.
In case that any product you purchase from us is defective/damaged, please contact us via email at SuggestionsAndClaims@charityshoptoxotis.org within 30 days since you have submitted your order. In your email, please include a photo of the defective/damaged product, where this is applicable. Please be aware that upon receiving your email, we will ensure to provide you with a new same product within 14 days.
We also reserve the right to request that you return the damaged product to us.
In case we run out of stock of the particular product or if it is a seasonal product and we cannot provide you with a new one on time, we will ask for your bank account details to give you your money back, again within 14 days since providing us with your bank account details.
7. Changes To Our Services:
You acknowledge and agree that we may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally, at our sole discretion, without prior notice to you.
You may stop using the Services at any time. You do not need to specifically inform us when you stop using the Services.
We may also from time to time and without notice to you, provide enhancements or improvements to the features/functionality of the Services, including updates, upgrades and other modifications. These may modify or delete certain features and/or functionality of the Services.
Furthermore, we reserve the right, at any time, without prior notice to you, to change our prices, billing methods and courier companies we cooperate with, immediately upon posting on our Site (where applicable).
8. Copyright Infringement Notice:
Be aware that all materials (including design of products) and logos in the Site are the copyrighted property of Toxotis Shop Ltd, hence it is prohibited for you to copy or modify or replicate or transmit or distribute any of it, in part or in whole, or systematically retrieve data from the Site or link any page of the Site to another website or use it in any other way, unless you obtain permission from Toxotis Shop Ltd and you use it without alteration in the same manner as the original and for non-commercial purposes only.
On the other hand, if you are a copyright owner or such owner’s agent and believe that any material from us constitutes an infringement on your copyright, please contact us via email at SuggestionsAndClaims@charityshoptoxotis.org.
9. Indemnification:
You agree to indemnify and hold us and the artists or other third parties or the members of Toxotis Charitable Foundation and their parents/guardians, harmless from any claim or demand, including reasonable attorney’s fees, due to or arising out of your: (a) use of the Services; (b) violation of these Terms of Service or any law or regulation; or (c) violation of any right of a third party.
10. No Warranties:
The Services are provided to you “AS THEY ARE” and “AS AVAILABLE”. Without limitation to the foregoing, we provide no warranty or undertaking, and make no representation of any kind that the Services will meet your requirements, achieve any intended results, operate without interruption, meet any performance or reliability standards or be error free.
11. Limitation of Liability:
Notwithstanding any damages that you might incur, the entire liability of us and any of our suppliers under any provision of these Terms of Service and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Services. To the maximum extent permitted by applicable law, in no event shall we or our suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.
12. Severability:
These Terms of Service, together with the Privacy Policy and any other legal notices published by us on the Services, shall constitute the entire agreement between you and us concerning the Services.
If any provision of these Terms of Service is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
13. Submissions and Privacy:
If you submit any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary and will become the sole property of us, without compensation or credit to you whatsoever.
14. Entire Agreement:
These Terms of Service constitute the entire agreement between you and us regarding your use of the Services and supersedes all prior and contemporaneous written or oral agreements between you and us.
15. Term and Termination:
These Terms of Service shall remain in effect, unless you request that we delete personal data from your account/profile created automatically when placing an order without creating an account, by emailing us at dpo@charityshoptoxotis.org.
Otherwise, we will delete personal data from your account/profile created automatically if there have been 2 years since your last order placed.
You acknowledge and agree that if we erase personal data from your account, you will no longer be able to access it, your account details or any other information which is contained in your account.
This will not affect you from creating a new account any time in the future or from submitting an order without creating an account.
16. Dispute Resolution:
Any and all disputes and differences arising from or in connection with these Terms of Services shall, where possible, be resolved through negotiations held in good faith between the Parties.
If the Parties fail to resolve any dispute or difference by such negotiation, then such dispute or difference may be referred to arbitration by either Party. These Terms of Service shall be governed by and shall be construed in accordance with the laws of the Republic of Cyprus. The seat of the arbitration shall be Nicosia Cyprus.
17. Updates To Our Terms of Service:
If we decide to update/change/improve these Terms of Service, we will post those updates/changes/improvements on this page, as well as update the “Effective Date” above.
If you continue to use the Services, you will be bound by the updated terms. If you do not agree to these or any updated terms, you can request us at dpo@charityshoptoxotis.org, to delete personal data from your account/profile automatically created.
